and so it begins.... supreme court justice sandra day o'connor has announced her retirement prior to the start of the new congressional session. i am hopeful that the nominations for her replacement will yield a fair and just candidate. i'm afraid of what will happen if all the checks and balances disappear... the executive branch and legislative branches are currently strongheld, and with this new appointment (as well as potential appointments with the retirement of the aging john paul stevens and the ailing william rehnquist) i fear that the judicial branch will also be commandeered. that does not bode well for democracy in this country...

Some commentators suggest that the big loss in Justice O'Connor's retirement is that she is the only member of the court with experience as an elected politician, a legislator. Most of the likely candidates are appellate court judges without experience running for public office.

Another commentator points out that the groups gearing up for an expensive campaign for or against the (as yet unidentified) nominee are those whose points of view do not prevail in the court of public opinion; they hope that the courts will impose those points of view on an unwilling public.

But democracy is doing just fine, thank you.
